Choctaw Nation v. United States

Appeals from the Court of Claims.
*2 There are two appeals in this case, -- one by the Choctaw Nation, and the other by the United States, -- from a judgment rendered by the court of claims in favor of the former, for the sum of $408,120.32. Jurisdiction of the cause was conferred upon that court by the provisions of an act of congress approved March 3, 1881, (21 St. at Large, 504,) entitled 'An act for the ascertainment of the amount due the Choctaw Nation,' as follows:
That the court of claims is hereby authorized to take jurisdiction of and try all questions of difference arising out of treaty stipulations with the Choctaw Nation, and to render judgment thereon. Power is hereby granted the said court to review the entire question of differences de novo, and it shall not be estopped by any action had or award made by the senate of the United States in pursuance of the treaty of 1855;
